Washington My Health My Data Act Policy

Scope of this Policy

If you reside in the State of Washington, this policy supplements Yelp’s Privacy Policy and applies to “consumer health data” as defined by the Washington State My Health My Data Act (“Consumer Health Data”). Terms not defined in this policy have the meaning ascribed to them in our Privacy Policy. 
 

Why We Collect and Use Consumer Health Data

While we don’t intentionally collect Consumer Health Data, we may come into possession of Consumer Health Data through your use of our Service. Yelp may collect and use Consumer Health Data in connection with your use of our Service for the purposes described in Section 1 of our Privacy Policy. For example, you may choose to share Consumer Health Data with businesses or other users on Yelp. We may also use Consumer Health Data for other purposes where you provide us consent to do so or as otherwise permitted by law. 

 

Categories of Consumer Health Data


The categories of personal information, including any Consumer Health Data, Yelp collects is described in Section 1 of our Privacy Policy. What constitutes Consumer Health Data varies depending on the context of your interactions with the Service. Examples of Consumer Health Data may include information such as:

  • Your public contributions to the Service that may relate to your health-related conditions, symptoms, status, diagnoses, testing, or treatments. For example, you may choose to write a review about a recent visit to a healthcare practitioner or you may choose to check-in at a medical provider’s office.  
  • Information that could identify your attempt to seek health care services or information, including services that allow you to assess, measure, improve, or learn about your health.
  • Information you choose to disclose, share and transmit through Request a Quote, Book an Appointment or other similar features that allow you to communicate with healthcare providers.
  • Other information that could be used to infer or derive data related to the above or other Consumer Health Data.

Sources of Consumer Health Data
 

Section 1 of our Privacy Policy explains the sources of personal information that we collect, which may include Consumer Health Data that you choose to share through your use of the Service. 
 

Sharing of Consumer Health Data
 

We may share each of the categories of Consumer Health Data described above for the purposes described in Section 1 of our Privacy Policy. We share your personal information, including Consumer Health Data, with your consent or as reasonably necessary to complete any transaction or provide any Service you have requested or authorized, as described above. 
 

Third Parties who may receive Consumer Health Data

Consistent with the purposes for which we collect Consumer Health Data, we share Consumer Health Data with the following categories of third parties:

  • Public Contributions: You may choose to share public contributions through our Service, including your photos, ratings, reviews, tips, lists, bookmarks and collections, compliments, which may indicate your attempt to acquire or receive health care services.

  • Advertisers and Businesses: You may choose to share Consumer Health Data with businesses on Yelp when you use Request a Quote, Book an Appointment or use other similar features to communicate with businesses. 
  • Other Users and Individuals: If you use our Service to interact with other users of the Service or other recipients of communications, we will share data, including Consumer Health Data, as directed by you and your interactions.
  • Service Providers: We rely on third-party service providers to support or provide services. Service providers performing services on our behalf may access Consumer Health Data for the purposes described in Section 3 of our Privacy Policy.
  • Affiliates: We may share information from or about you with our parent companies, subsidiaries, or other companies under common control in accordance with the terms of this Privacy Policy. Such affiliates of Yelp Inc. may include Yelp UK Ltd., Darwin Social Marketing Inc., Yelp Ireland Limited, and Yelp GmbH.
  • Other Third Parties: In certain circumstances, it may be necessary to provide data to other third parties, for example, to comply with the law or to protect our rights or those of our users.

How to Exercise Your Rights

If you are a resident of Washington, you have the right to access, delete, or withdraw consent as it relates to Consumer Health Data, subject to certain exceptions. While we don’t intentionally collect Consumer Health Data, we may come into possession of Consumer Health Data through your use of our Service as set forth above. Depending on the Consumer Health Data you choose to share, you may be able to view or take action regarding your Consumer Health Data through your account settings. For example, through your account settings, you can limit the visibility of some of your activities, request to exercise certain of your rights, and view your activity, public contributions and your communications with businesses.
